- List each clause that grants a payment out of production, an overriding royalty, or an assignment of record title or operating rights, with the page. Do not draft a recordable instrument and do not say that the Bureau of Land Management will approve the deal.
- What the lawyer must review
- 43 C.F.R. § 3106.10 provides that an assignment of a separate zone, deposit, depth, formation, specific well, or part of a legal subdivision will be denied, and that within a federal lease operating rights may be divided only with respect to legal subdivisions, depth ranges, and formations. A transfer of production payments, overriding royalty, or other similar payments must be filed in the proper BLM office and does not require approval. An assignment of record title or of operating rights is not recognized until the authorized officer approves it. Section 3106.41 requires that transfer to be filed on a current form approved by the Director. A private royalty, streaming, or offtake contract can create obligations the regulations do not. The lawyer decides whether the draft is only a payment out of production or is an assignment of record title or operating rights. 30 U.S.C. § 226 is the leasing statute for the underlying federal lease. The tool does not calculate a royalty rate.
