Quote whether the instrument lets an attorney appoint a delegate
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Quote any clause about appointing a delegate or a substitute attorney. If the instrument does not allow it, say so. Do not draft an appointment.
- What the lawyer must review
- You decide whether a delegation is permitted. No statute on delegation by an attorney-in-fact was opened. A power to appoint must be in the instrument. The tool does not imply one. Model Rule 1.4(b) applies before an appointment is made. Model Rule 1.6 applies to information given to the delegate. Formal Opinion 512 requires you to verify the quote. You write any appointment.
