What the lawyer must review
Goss v. Lopez, 419 U.S. 565 (1975): for a public-school suspension of 10 days or less, due process requires oral or written notice of the charges and, if the student denies them, an explanation of the evidence and an opportunity to present the student’s version. Notice and hearing should generally precede removal. Where the student’s presence endangers persons or property or threatens disruption of the academic process, the student may be removed at once, and the notice and hearing should follow as soon as practicable. The Court limited that holding to a short suspension not exceeding 10 days and said longer exclusions may require more formal procedures. Education records disclosed with the notice are governed by 20 U.S.C. § 1232g and 34 C.F.R. § 99.31, including disclosure to the parent of a student who is not an eligible student under § 99.31(a)(12), and to parents of a dependent student under § 99.31(a)(8). The lawyer writes anything that is sent. Rule 1.6 and Formal Opinion 512 keep the student’s record out of a public tool.
