How AI is used
From the attendance roll, list each full-day absence, whether an explanation is on the file, the date the explanation was received, and the name of the parent on the enrolment record. Do not decide that an explanation is reasonable, and do not write a notice.
What the lawyer must review
The lawyer decides whether a notice may issue and writes it. In Victoria, the Department of Education states that before a school attendance notice is issued the school attendance officer must be satisfied that the student has been absent on at least five full days in the previous 12 months and the parent has not provided a reasonable explanation, that measures to improve attendance have been undertaken and been unsuccessful, or are inappropriate in the circumstances, and that a parent responsible for the absences can be identified. The notice is addressed to one person. The form is prescribed in the Education and Training Reform Regulations 2017. The date for a response is no less than 21 days after the notice is issued. If the officer accepts the explanation, the officer sends a letter confirming the parent has met the obligation and instructs the principal to amend the attendance record. If the parent does not respond in the prescribed time, the department's guidance states that the parent has committed an offence. The officer must try to contact the parent before deciding on an infringement notice. If one parent nominates another, the officer checks the enrolment record before issuing a fresh notice. In New South Wales, the Department of Education states that a child must start school by age 6 and complete year 10, and that a parent must give an explanation for an absence within 7 days from the first day of the absence, failing which the absence is recorded as unexplained. No notice procedure and no offence are stated on that page, so none is added here. The lawyer uses only the rule of the school's jurisdiction.

  2. For a Victorian notice, check the response date is at least 21 days after issue and that the notice names one parent who is on the enrolment record.
  3. Confirm the notice, if any, is written by the lawyer and uses only the rule for the school's jurisdiction.
