How AI is used
From the closure note and the enrollment list, list the event, the date the institution says operations will cease or a location providing one hundred percent of at least one program will close, and whether a teach-out plan is already on the file. Do not decide that a teach-out trigger has occurred, and do not write the plan or the notice to students.
What the lawyer must review
You decide whether a teach-out plan is required and you write the plan and any student notice. 34 CFR 602.24(c) requires an accrediting agency to require a teach-out plan, upon stated events, from an institution it accredits. Those events include, for a nonprofit or proprietary institution, a Secretary notice of an auditor's going-concern doubt, adverse opinion, or material weakness related to financial stability; the agency placing the institution on probation or equivalent status; and a Secretary notice that a teach-out plan is a condition of a provisional program participation agreement. A plan and, if practicable, teach-out agreements are required on a Secretary notice of reimbursement or heightened cash monitoring under 34 CFR 668.162(d)(2), an emergency action or an action to limit, suspend, or terminate Title IV participation, the agency withdrawing, terminating, or suspending accreditation or preaccreditation, the institution's notice that it will cease operations or close a location that provides one hundred percent of at least one program, or a State licensing agency's notice that a license or authorization has been or will be revoked. The agency must check that the plan lists currently enrolled students, the programs, and other institutions that offer similar programs and could enter a teach-out agreement. A closing institution's teach-out agreement must include a plan to give all potentially eligible students information on how to obtain a closed-school discharge and, if applicable, information on State refund policies, and a record-retention plan for the students. If an institution closes without a plan or agreement, the agency must work with the Department and the appropriate State agency, to the extent feasible, to help students find a way to finish without additional charges. 34 CFR 602.22(a)(1)(ii)(H) treats as a substantive change the addition of a permanent location at a site where the institution is conducting a teach-out for students of another institution that ceased operating before all students finished.
