How AI is used
From the request or the provider's proposed decision, the enrolment record and the complaints file, list whether the change is student-initiated or provider-initiated, the ground relied on, whether the end date of the confirmation of enrolment would change, the date written notice of an intention to suspend or cancel was given, and the date 20 working days after that notice. List whether the file records advice that the student seek advice from the Department of Home Affairs, and whether a student under 18 still has welfare arrangements in place. Do not decide the change and do not write the notice.
What the lawyer must review
The lawyer decides whether to defer, suspend or cancel, and writes the notice. The Department of Education Standard 9 factsheet states that a registered provider must have a documented process for assessing, approving and recording a deferment, suspension or cancellation, must notify the student in writing of an intention to suspend or cancel, must tell the student to seek advice from the Department of Home Affairs on the visa effect, and must not let a suspension or cancellation take effect until the student has had a chance to complete an internal appeals process, unless the health or wellbeing of the student or of others is likely to be at risk. A provider-initiated change requires a notice of intention to report and 20 working days to access the internal complaints and appeals process, including where misbehaviour would otherwise justify immediate expulsion, unless that wellbeing exception applies. The provider generally proceeds after the internal process for misbehaviour and non-payment. For a breach of course progress or attendance the factsheet says the provider waits until both the internal and the external processes are complete. If the wellbeing exception is used, the change may take effect immediately, the student can still appeal, and a result in the student's favour must be reversed immediately. Compassionate or compelling circumstances are generally beyond the student's control and affect course progress or wellbeing. The factsheet's examples include serious illness supported by a medical certificate, bereavement of a close family member, major political upheaval or a natural disaster requiring emergency travel, a traumatic experience supported by a police or psychologist's report, and a missing prerequisite unit. There is no maximum deferral period stated for compassionate or compelling reasons. The provider notifies the Department of Education through PRISMS. A suspension period entered in PRISMS is not included in attendance monitoring. Cancelling a confirmation of enrolment does not cancel welfare arrangements for a student under 18. The factsheet says compliance is measured against the National Code, not the factsheet. This task does not replace the intention-to-report for unsatisfactory course progress.

Checklist

  1. Record whether the change is student-initiated or provider-initiated, and whether it would change the end date of the confirmation of enrolment.
  2. Count 20 working days from the written notice, and record whether the ground is course progress or attendance, which the factsheet says waits for the external process as well.
  3. Confirm the notice and the PRISMS outcome are the lawyer's, and that welfare arrangements for a student under 18 are still recorded.
