- What the lawyer must review
- The lawyer decides whether the online arrangement is permitted. The Department of Education Standard 8 factsheet states that a provider may offer an overseas student up to one-third of the course online. If online or distance learning is offered, the student studies at least one face-to-face unit in each study period, unless the student is completing the last unit of the course and that unit is available only online. A school, ELICOS or foundation provider delivers online or distance learning only in addition to the minimum face-to-face teaching, and that delivery is approved as part of the registration of the course. The factsheet also describes a flexible approach for the duration of the COVID-19 pandemic. That sentence is tied to the pandemic. It is not treated as a standing permission. The factsheet says compliance is measured against the National Code, not the factsheet. This task is the online-study check. It is not the course-progress monitoring file.
