Check a transfer request from an overseas student
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the enrolment record, the letter of offer and the request, list the principal course, the date that course commenced, whether 12 calendar months have passed, and whether the student is in a school-sector course. List which of the release conditions on the Department's Standard 7 factsheet the file appears to meet, and the date 20 working days after any notice of refusal. Do not decide the request, and do not write the outcome or the reasons.
- What the lawyer must review
- The lawyer decides whether a release is required and whether it is granted, and writes any notice of the outcome. The Department's Standard 7 factsheet, modified on 2 October 2026, states that a registered provider must not knowingly enrol an overseas student transferring from another provider before the student has completed 12 calendar months of the principal course, unless the student has a release or one of the stated exceptions applies: the releasing provider or the course has ceased to be registered; a sanction prevents the student continuing; or a government sponsor has given written support. The first 12 months run from the date the principal course commences, and the restriction also applies to courses before the principal course. On 1 July 2027 the factsheet says the period reverts to 6 months for students other than school students. School-sector students are restricted until 6 calendar months of their first registered school course. A student under 18 needs written support from a parent or legal guardian, and if no parent or guardian is caring for the student in Australia the receiving provider must accept the welfare arrangements under Standard 5. A refusal must not be finalised in PRISMS until an appeal upholds the refusal, the student does not access the complaints process within 20 working days, or the student withdraws the appeal. The provider must give written reasons and tell the student of the right to the internal complaints process within 20 working days. Records of transfer requests are kept for 2 years after the student ceases to be an accepted student. A hard-copy release letter is not required. The lawyer reads Standard 7.2.2.1 to 7.2.2.6 before treating a best-interests ground as made out.
