List reports in the file before any diversion paper is written
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- List each report in the file by date, author, and the diagnosis or finding in the report's words. Do not write an application and do not say a charge can be diverted.
- What the lawyer must review
- You write any application. No diversion statute was opened. Section 3553(a) says the court shall impose a sentence sufficient, but not greater than necessary, to comply with the purposes in paragraph (2), and it lists factors that include the nature and circumstances of the offense and the history and characteristics of the defendant. That section is about imposing a sentence. It is not a statute that diverts a charge. The Guidelines Manual was not opened. Model Rule 1.6 limits what you send with any application. Model Rule 3.3 governs what you tell the court. The tool does not outline the person's history.
