Set each sentence of the client's summary beside the condition in the federal release order, or mark the sentence as not in the order. Do not add a condition.
What the lawyer must review
You correct the explanation. In a federal case, § 3142(a) and (c) govern release on personal recognizance, an unsecured bond, or conditions. The judicial officer orders the least restrictive further condition, or combination, that will reasonably assure appearance and the safety of any other person and the community. Section 3142(j) says nothing in the section modifies the presumption of innocence. Model Rule 1.4(b) requires the explanation to match the order the client must obey. A state release order is not reviewed under § 3142. Formal Opinion 512 applies if the summary is put into a tool.
