Index counts, witnesses and exhibits for a trial note
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each count the charging paper states, and the witnesses and exhibit numbers the lawyer assigns. Do not write a case statement.
- What the lawyer must review
- You write any case statement. Rule 16(a), upon the defendant's request, requires disclosure of specified statements, the prior record, and documents and objects in the government's possession, custody, or control that are material to preparing the defense, that the government intends to use in its case-in-chief, or that were obtained from or belong to the defendant. Brady v. Maryland holds that suppression, upon request, of favorable evidence material to guilt or to punishment violates due process. The index is not that disclosure and it is not a finding that the evidence proves a count. Model Rule 3.3 applies to what you later say the index shows.
