Index the hearing documents without narrating the events
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- Index each document by date and by who produced it. Do not narrate what a person saw or heard and do not outline an account for the hearing.
- What the lawyer must review
- You write any account that is filed, and you decide what is disclosed. Brady v. Maryland holds that the suppression by the prosecution of evidence favorable to an accused upon request violates due process where the evidence is material either to guilt or to punishment, irrespective of the good faith or bad faith of the prosecution. Later cases were not opened. Rule 16(a)(1)(E), upon a defendant's request, requires the government to permit inspection and copying of listed items in its possession, custody, or control if the item is material to preparing the defense, the government intends to use it in its case-in-chief at trial, or it was obtained from or belongs to the defendant. That rule is not a privilege and it is not a script for a person's account. A state local-court hearing is not Rule 16 until you confirm the rule applies. Model Rule 3.3 applies to evidence you offer.
