How AI is used
Mark whether the draft states opinions, bases, qualifications, publications, and other testimony. Quote the page for each that is present. Do not write instructions and do not add an opinion.
What the lawyer must review
You write the instructions and you decide whether the draft is usable. Rule 16(a)(1)(G), at the defendant's request, requires the government to disclose in writing, for testimony it intends to use under Evidence Rules 702, 703, or 705 in its case-in-chief or in rebuttal to timely disclosed defense testimony, a complete statement of the opinions, the bases and reasons, the qualifications including publications in the previous 10 years, and a list of other cases in the previous 4 years in which the witness testified as an expert at trial or by deposition. The witness must approve and sign unless the government states why it could not obtain the signature through reasonable efforts. The court sets the time. The defense disclosure rule, Rule 16(b)(1)(C), was not set out in this check. Do not treat (G) as the defense form. Model Rule 3.3 applies to an opinion you later put before the court.
