Check that a tool has not written a proof or a character letter
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- List any draft in the file that is a proof of facts for a court or a letter to be signed by a third person. Record that those drafts are for the lawyer, not for the tool to finish. Do not finish them.
- What the lawyer must review
- You write anything that is handed up or signed. Model Rule 3.3 is the duty of candor toward the tribunal. Formal Opinion 512 warns against relying on generated text you have not checked. A letter signed by a third person is that person's statement. A proof of facts for a court is yours. This check does not produce either. Comment 8 to Rule 1.1 requires you to understand the tool well enough not to let it supply those documents.
