Prepare and track a Rule 45 subpoena
Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- List the person, the documents and the date the lawyer has set, and track service once the lawyer records it. Write none of the command that will be served.
- What the lawyer must review
- Rule 45 requires every subpoena to state the court, the title and the command. It issues from the court where the action is pending. An attorney authorized to practice in that court may issue and sign it. If the subpoena commands production or inspection before trial, notice and a copy must be served on each party before it is served on the person named. The lawyer completes and signs the subpoena. The tool does not. A state subpoena is not Rule 45.

Who does what
| Role | What they do |
|---|---|
| Assistance | Supporting preparation only. Consider narrowly defined preparation support after confirming the tool’s capability and permitted scope. The tool writes nothing into the document. Substantive advice, judgement and any restricted content remain with the responsible human. |
| Lawyer | Perform the substantive analysis and decisions. Independently check any permitted supporting work and approve the exact output for its intended use. |
Checklist
- Confirm the output against the client’s instructions and the complete relevant source material, including omissions or contradictions.
- Resolve exceptions and record the responsible lawyer’s approval of the exact output and intended use.
