How AI is used
From the pleading and the court record, record the date the pleading was served, the date any responsive pleading was served, the date any motion under Rule 12(b), Rule 12(e), or Rule 12(f) was served, and whether the opposing party has given written consent. Do not draft the amendment.
What the lawyer must review
You decide whether Rule 15(a) allows one amendment as a matter of course, or whether written consent or leave is required, and you write the amended pleading. A party may amend once as a matter of course no later than 21 days after serving the pleading or, if a responsive pleading is required, 21 days after service of a responsive pleading or of a motion under Rule 12(b), 12(e), or 12(f), whichever is earlier. In all other cases the opposing party's written consent or the court's leave is required. The court should freely give leave when justice so requires. Presenting the amended pleading is a Rule 11 certification. Formal Opinion 512 requires you to review any generated allegation or citation before it is submitted to the court.
