Check a costs and funding disclosure against the judge's order
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Compare the draft disclosure with the items the lawyer has copied from the scheduling order or the judge's standing order. Flag an item on that list which the draft does not address. Do not add an item.
- What the lawyer must review
- You decide what the order requires and you write anything filed. There is no national practice note in the rules opened for this task. Federal Rule of Civil Procedure 23 governs class certification, notice and, in Rule 23(h), a later fee motion. It is not a substitute for the judge's order on what must be said about funding at the first hearing. You read that order. Formal Opinion 512: the comparison is not the disclosure.
