Advise whether a class certification should be altered or amended
Key facts

- RedLawyer-led
- How AI is used
- From the pleadings and the orders the lawyer selects, list the facts that touch numerosity, common questions, typicality, adequacy, and the Rule 23(b) type under which the class was certified. Tag each fact to a document. Do not write the motion or express a conclusion.
- What the lawyer must review
- You decide whether to ask the court to alter or amend the certification order, and you write the motion. An order that grants or denies class certification may be altered or amended before final judgment. The court may also order that the pleadings be amended to eliminate allegations about representation of absent persons and that the action proceed accordingly. The prerequisites remain those in Rule 23(a) and (b). A court of appeals may permit an appeal from an order granting or denying certification, but the petition is due within 14 days after the order is entered, or 45 days if a party is the United States, a United States agency, or a United States officer or employee sued for an act or omission in connection with duties on the United States' behalf. Presenting the motion is a Rule 11 certification. Formal Opinion 512 requires you to review generated analysis and citations before filing.
