How AI is used
From the judgment and the exclusion record, record how the judgment describes the people it includes, whether the Rule 23(c)(2) notice was directed to this person, and whether this person requested exclusion. Do not say that the person is bound.
What the lawyer must review
You decide whether the judgment includes the person, and you write the advice. Whether or not favorable to the class, the judgment must, for a class certified under Rule 23(b)(1) or (b)(2), include and describe those whom the court finds to be class members. For a class certified under Rule 23(b)(3), it must include and specify or describe those to whom the Rule 23(c)(2) notice was directed, who have not requested exclusion, and whom the court finds to be class members. Formal Opinion 512 requires you to check any generated comparison against the judgment before you advise the client.
