- How AI is used
- List the order date, the court the order names, and whether the file describes the order as a judgment in a proceeding under section 300 or as a subsequent order. Leave a blank for the number of days. Write no notice of appeal.
- What the lawyer must review
- You look up the number of days, and you write the notice of appeal. Welfare and Institutions Code § 395(a)(1) provides that a judgment in a proceeding under § 300 may be appealed in the same manner as any final judgment, and any subsequent order may be appealed as an order after judgment. The appeal does not stay the order or judgment unless, pending the appeal, suitable provision is made for the maintenance, care, and custody of the person alleged or found to come within § 300, and that provision is approved by an order of the juvenile court. The appeal shall have precedence over all other cases in the court to which the appeal is taken. Section 395 states no number of days. Section 300 was not opened beyond that cross-reference. Section 395(a)(2) provides that a judgment or subsequent order entered by a referee becomes appealable when proceedings pursuant to §§ 252, 253, or 254 have been completed or, if those proceedings are not initiated, when the time for initiating them has expired. Sections 252, 253, and 254 were not opened. Open them before you treat a referee order as appealable. Sections 671 and 675 of title 42 are conditions of a Title IV-E state plan. They do not state the number of days to appeal a judgment under § 395.
