Record whether an award request is a correction or an interpretation
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the award and the error the lawyer identifies, record whether the request is an interpretation, a clerical, typographical, or computational correction, or a court application to modify or correct the award, and record the day counts that apply. Do not write the request.
- What the lawyer must review
- You write any request to the arbitrator and any application to the court. Rule R-52 says that within 20 calendar days after transmittal of any award, a party, on notice to the others, may request the arbitrator, through the AAA, to interpret the award or to correct any clerical, typographical, or computational errors. The arbitrator is not empowered to redetermine the merits of any claim already decided. The other parties have 10 calendar days to respond. The arbitrator shall dispose of the request within 20 calendar days after the AAA transmits the request and any response. A different schedule set by the arbitrator supersedes those deadlines. A court application is 9 U.S.C. § 11. The United States court for the district in which the award was made may modify or correct the award, on application of any party, where there was an evident material miscalculation of figures or an evident material mistake in the description of any person, thing, or property; where the arbitrators awarded upon a matter not submitted to them, unless it is a matter not affecting the merits of the decision upon the matter submitted; or where the award is imperfect in matter of form not affecting the merits of the controversy. The order may modify and correct the award so as to effect its intent and promote justice. Section 11 does not give a free-standing power to interpret an ambiguous award.
