List the agreed terms for a settlement agreement or a consent award
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the term sheet or the exchange in the file, list each term the parties have already written down, in their words. Do not write the agreement or the award.
- What the lawyer must review
- The lawyer writes every sentence that will be signed, including any consent award the tribunal is asked to make. 9 U.S.C. § 9 allows a party to apply for an order confirming an award within one year after the award is made if the parties have agreed that a judgment of the court shall be entered upon the award. If the agreement does not say that, § 9 is not the confirmation path. Federal Rule of Evidence 408 limits later use of the compromise to prove or disprove validity or amount. Formal Opinion 512: the term list is checked before the lawyer drafts.
