- List dates, sums, party names, and relief in the draft award that conflict with another paragraph of the same draft, and give both paragraph numbers. Do not rewrite the award.
- What the lawyer must review
- The arbitrators write the award. 9 U.S.C. § 10(a)(4) allows vacatur where the arbitrators exceeded their powers, or so imperfectly executed them that a mutual, final, and definite award upon the subject matter submitted was not made. The lawyer decides whether a conflict in the draft is that kind of defect. Formal Opinion 512: the lawyer verifies each flagged pair before anyone comments on the draft. Rule 1.6 covers the draft.
