From the notice, the disclosed claim and counterclaim amounts, and the number of parties, list whether any disclosed claim or counterclaim exceeds $100,000 exclusive of interest, attorneys' fees, and arbitration fees and costs, and whether there are more than two parties. Do not write an application and do not decide that the administrator determines otherwise.
What the lawyer must review
You decide whether to agree to the expedited procedures, and you write any application. Rule R-1(b) says that, unless the parties agree or the AAA determines otherwise, the Expedited Procedures apply if no disclosed claim or counterclaim exceeds $100,000, exclusive of interest, attorneys' fees, and arbitration fees and costs. The parties may agree to use them in larger cases. Unless the parties agree otherwise, they do not apply if there are more than two parties. They are applied as Procedures E-1 through E-10, plus any other rule that does not conflict. E-1 allows, except in extraordinary circumstances, no more than one seven-day extension to respond to the demand or counterclaim under Rule R-5. Other extensions are considered only after E-7. E-5 requires exhibits to be exchanged at least two business days before the hearing, allows no other discovery except by the arbitrator for good cause, and allows no motions except for good cause. If the arbitrator allows additional discovery, the AAA, in consultation with the arbitrator, may remove the case from the Expedited Procedures. E-6 resolves the dispute on documents where no party's claim exceeds $25,000, exclusive of interest, attorneys' fees and arbitration costs, and in other cases the parties agree, unless a party requests an oral hearing or the arbitrator determines that one is necessary. E-7 schedules a hearing no more than 60 days after the preliminary hearing, or as the parties and the arbitrator mutually agree. E-8 says that, absent good cause, the hearing shall not exceed one day. One additional day may be scheduled within seven business days, or as soon as practicable. If the hearing is scheduled to exceed one day, the AAA, in consultation with the arbitrator, may remove the case from the Expedited Procedures. 9 U.S.C. § 2 makes the written agreement to arbitrate enforceable. It does not set these dollar figures. The footnotes to Rule R-1 give the AAA a path to the Employment/Workplace Rules or the Consumer Rules in the disputes those footnotes describe.
