How AI is used
Record the charge filing date, any state or local agency date in the file, the date of any notice, and whether the respondent is a government, governmental agency or political subdivision. Write no complaint.
What the lawyer must review
You write the complaint. Section 2000e-5(f)(1) provides that, if the Commission cannot secure an acceptable conciliation agreement within thirty days after the charge or after a referral period, the Commission may sue a non-government respondent. A government respondent is referred to the Attorney General, who may sue, and the aggrieved person may intervene in that action. If the charge is dismissed, or if within one hundred and eighty days from filing or the end of any referral period, whichever is later, no Commission suit, no Attorney General suit against a government respondent, and no conciliation agreement to which the aggrieved person is a party, the Commission or the Attorney General gives notice, and a civil action may be brought within ninety days after that notice. The court may appoint an attorney and authorise commencement without fees, costs or security, and may stay proceedings for not more than sixty days pending state or local proceedings or further voluntary-compliance efforts. Section 2000e-5(f)(2) allows the Commission, or the Attorney General in a government case, to seek temporary or preliminary relief, issued under Federal Rule of Civil Procedure 65. You calculate the ninety days from the notice in the file. You do not file on the one-hundred-and-eightieth day unless the notice condition is met.
