- How AI is used
- From the file, list the institution, whether the file describes a strike, picketing, or other concerted refusal to work, and the date and time the file states the action will commence. Do not write the notice, and do not count the ten days unless that date is in the file.
- What the lawyer must review
- You write and give any notice. Section 8(g) (29 U.S.C. § 158(g)) provides that a labor organization, before engaging in any strike, picketing, or other concerted refusal to work at a health care institution, shall, not less than ten days before that action, notify the institution in writing and the Federal Mediation and Conciliation Service of that intention. The notice states the date and time the action will commence. It may be extended by the written agreement of both parties. Where bargaining is for an initial agreement following certification or recognition, the section 8(g) notice shall not be given until the period in section 8(d)(B) has expired. That clause requires at least thirty days' notice of the dispute to the agencies named in section 8(d)(3). Section 8(d) provides that an employee who strikes within a notice period specified in that subsection, or within the appropriate period specified in subsection (g), loses employee status for the purposes of sections 158, 159, and 160 until reemployed. Section 7 protects concerted activity and the right to refrain. The definition of health care institution was not opened. The opened text does not require a ballot application to a tribunal before the action.
