- How AI is used
- From the file, list any request that an agreement be put in a written contract, whether a signed writing is in the file, and the date of that writing. Do not draft the contract, and do not say that a tribunal has approved it.
- What the lawyer must review
- You decide whether the bargaining duty has been met, and you write any contract. Section 8(d) (29 U.S.C. § 158(d)) defines bargaining as the mutual obligation to meet at reasonable times and confer in good faith about wages, hours, and other terms and conditions of employment, or the negotiation of an agreement, or any question arising under it, and the execution of a written contract incorporating any agreement reached if requested by either party. The obligation does not compel either party to agree to a proposal or require a concession. Where a collective-bargaining contract is in effect, a party may not terminate or modify it unless it gives the written notices and follows the steps in section 8(d)(1) to (4). The opened text does not require the Board to approve the agreement before it has effect. Section 301(a) (29 U.S.C. § 185(a)) provides that a suit for violation of a contract between an employer and a labor organization representing employees in an industry affecting commerce, or between such labor organizations, may be brought in a district court of the United States having jurisdiction of the parties, without regard to the amount in controversy or the citizenship of the parties. A money judgment against a labor organization in a district court is enforceable only against the organisation as an entity and its assets, and not against an individual member or the member's assets.
