How AI is used
List, from the file, the organisation's name and addresses, its officers and titles, its initiation fees and dues, and the figures the file gives for assets, receipts, officer and employee disbursements, and loans. Record the fiscal year end the file states. Do not sign a report, and do not count the 90 days unless that year end is in the file.
What the lawyer must review
You prepare and sign any report that is filed. 29 U.S.C. § 431(a) requires every labor organisation to adopt a constitution and bylaws and to file a copy with the Secretary, together with a report signed by its president and secretary or corresponding principal officers. The report contains the name, mailing address, and any other address of the principal office or of the records; the name and title of each officer; the initiation fee or fees and fees for work permits; the regular dues or fees required to remain a member; and the detailed statements, or references to filed documents, on the procedures in paragraph (a)(5), including qualifications for membership, assessments, benefit plans, authorisation for disbursement, audit, meetings, selection of officers and stewards, discipline of officers, fines and expulsions, bargaining demands, ratification of contract terms, authorisation for strikes, and work permits. Any change in the information required by subsection (a) is reported at the time the organisation files the annual financial report. Subsection (b) requires an annual financial report, signed by the president and treasurer or corresponding principal officers, containing assets and liabilities at the beginning and end of the fiscal year, receipts and their sources, salary and other disbursements to each officer and to each employee who received more than $10,000 in the aggregate from the organisation and affiliated organisations, direct and indirect loans to any officer, employee, or member which aggregated more than $250, loans to any business enterprise, and other disbursements including their purposes, in such categories as the Secretary may prescribe. The statute says the financial report is filed annually. 29 CFR § 403.2(a) requires every labor organisation to file with the Office of Labor-Management Standards, within 90 days after the end of each of its fiscal years, a financial report signed by its president and treasurer or corresponding principal officers. Subsection (c) of the statute requires the organisation to make the reported information available to all members, and gives a member, for just cause, a suit to examine books, records, and accounts necessary to verify the report. The court may allow a reasonable attorney's fee and costs.
