How AI is used
From the file, list the limitation the file states, whether the person is described as an applicant or an employee or as a person dealing with a public entity, and the change the file requests. Do not draft an exemption application, and do not decide undue hardship.
What the lawyer must review
You decide whether the statute requires a change, and you do not file an exemption application on the strength of these sections. Title I, 42 U.S.C. § 12112(b)(5)(A), makes it discriminatory for a covered entity not to make reasonable accommodations to the known physical or mental limitations of an otherwise qualified individual with a disability who is an applicant or employee, unless the covered entity can demonstrate that the accommodation would impose an undue hardship on the operation of its business. Section 12112(b)(5)(B) makes it discriminatory to deny an employment opportunity because of the need to make such an accommodation. The definitions of qualified individual, covered entity, and undue hardship were not opened. Title II, 42 U.S.C. § 12132, provides that no qualified individual with a disability shall, by reason of that disability, be excluded from participation in or be denied the benefits of the services, programs, or activities of a public entity, or be subjected to discrimination by such an entity. The definitions of qualified individual and public entity were not opened. Neither section provides for an application to a commission for a temporary exemption from the statute.
