From the loan file, list the lender, the balance, the default notice, and any USDA loan or guarantee, and note whether the state is one the lawyer has confirmed as a qualifying mediation state. Do not say enforcement is barred.
What the lawyer must review
7 U.S.C. § 5101 requires a qualifying state's program to offer mediation of agricultural loans, whether or not the Secretary made or guaranteed them. The program may also cover wetlands determinations, farm-program compliance, and agricultural credit. The Farm Service Agency describes the Certified Mediation Program as voluntary. You confirm the state is certified and you read that state's mediation statute before you tell a lender it must mediate. Do not treat this as a mandatory farm-debt gate.
