- A lease of land is state law. California Civil Code § 1624(a)(3) makes an agreement to lease real property for longer than one year invalid unless it, or a note or memorandum, is in writing and subscribed by the party to be charged. Section 1624(c) excludes leases under Commercial Code Division 10, which are personal-property leases, not farm land. You adapt the operative clauses and you confirm the statute of frauds in the state of the land. Formal Opinion 512: do not leave a tool's clause in a document anyone will sign.
