Table farm-product security notices against a sale
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- For each sale, list the product, the seller, the buyer, the sale date, any written security notice and its date, whether the file shows a central filing system certified by the Secretary of Agriculture, whether the buyer registered, and whether an effective financing statement or a waiver is in the file. Do not say the buyer takes free of the interest.
- What the lawyer must review
- 7 U.S.C. § 1631 lets a buyer in ordinary course of business take farm products free of a security interest created by the seller, unless subsection (e) applies. The buyer takes subject to the interest if, within one year before the sale, the buyer received a written notice meeting the section, or if, in a state with a certified central filing system, the buyer failed to register and an effective financing statement covers the products, or the buyer received the Secretary of State's written notice and did not obtain a waiver. A central filing system is one the Secretary of Agriculture has certified. You decide which path applies.
