- How AI is used
- List the agency action, the statute the decision cites, and the record pages that touch each ground in 5 U.S.C. § 706. Write no paragraph of the petition or the brief.
- What the lawyer must review
- You plead the case. Under § 706 the reviewing court decides relevant questions of law and shall compel agency action unlawfully withheld or unreasonably delayed, and set aside action found to be arbitrary and capricious or otherwise not in accordance with law, contrary to constitutional right, in excess of statutory authority, without procedure required by law, unsupported by substantial evidence in a case under §§ 556 and 557 or another statutory on-the-record hearing, or unwarranted by the facts where the facts are tried de novo. Review is on the whole record, with the rule of prejudicial error. Rule 11 applies to the petition. Finality is § 704, not this section.
