Queensland courts AI practice direction

Queensland Courts publish a page on using generative AI and point lawyers to the accuracy directions. Supreme Court Practice Direction 5 of 2025 requires the responsible practitioner to be named at the end of written submissions and to verify the references. It does not require a statement that generative AI was used. Before a submission is filed, open the direction for that court.

Supreme Court Practice Direction 5 of 2025 does not automatically govern QCAT or the Planning and Environment Court. The Queensland Law Society’s Guidance Statement No. 37 is the professional counterpoint for any Queensland practice, including files that never go to court: know whether the tool will keep client information confidential before you use it.

Guidelines written for people without lawyers are not the solicitor’s standard. A solicitor’s obligation is the practice direction plus the Society’s guidance.

Disclosure checklist

Work through this against the instrument, not instead of it. The checks do not record that the filing is done.

  • Open the Queensland Courts AI page and the accuracy direction for the court named on the file.
  • Verify every reference in the submission, including pinpoints. Do not rely on the tool that produced the reference.
  • Treat QCAT Practice Direction 10 of 2025 as that tribunal’s own direction.
  • Work through Guidance Statement No. 37’s confidentiality questions before client material is uploaded.
  • If the provider’s terms do not clearly say how confidential data is stored, reused and shared, do not upload the file.

Questions

Which Queensland direction do I open?

The one for the court or tribunal on the file. Supreme Court PD 5 of 2025 is not the QCAT direction and not the District Court direction.

What has to be disclosed or checked?

The accuracy directions exist so that references in submissions are real. Open each reference in a source you trust. Confidentiality is a separate question under Guidance Statement No. 37.

Do these directions apply in New South Wales?

No. A Queensland accuracy direction is not SC Gen 23, and the reverse is also true.
