When to use it
Use when a client is depicted in synthetic or altered material and wants it removed quickly. If the material may depict a person under 18, do not use this letter: report to police and eSafety. For intimate images of adults, explain the eSafety route first.
How AI may be used
AI may assemble the capture schedule and a first draft from lawyer-selected material. It cannot prove that content is synthetic, and intimate imagery must never be put into an AI tool.
AI may
- Build the location and capture schedule from URLs, timestamps and hashes the lawyer supplies
- Produce a first draft from the legal bases and remedies the lawyer has selected
- Summarise the platform's published reporting channels and response times for the lawyer to confirm
AI must not
- Must not be used on intimate images, or on any image of a person who may be under 18: never upload them to an AI tool or online detection service
- Must not present an AI detection score as proof that content is synthetic
- Must not add any threat of a criminal or regulatory complaint conditional on compliance
The lawyer checks
- The client's instructions and preserved originals support every factual statement about the material
- Each legal basis selected fits the facts and the governing jurisdiction
- Child-safety and family-violence risks were assessed before the letter is sent
- The client has been told about the eSafety reporting route where intimate imagery is involved
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
