When to use it
Use when making or opposing a bail application in the NSW Local, District or Supreme Court and a short written outline will help the court. Adapt the test where a special limitation applies (ss 22, 22A, 22B or 22C), and do not use it for interstate bail law without rewriting the statutory framework.
How AI may be used
Lawyer-led. AI may organise the material the lawyer has gathered against the statutory matters and check the draft for unsupported assertions; it writes no part of the submissions handed up and no part of any affidavit.
AI may
- Table the s 18 matters against documents the lawyer supplies (bail history, criminal record, surety and address documents) in a firm-approved tool that does not train on inputs, with a page reference for each entry.
- Check the lawyer's draft conditions against each s 20A(2) requirement and list any condition with no stated bail concern.
- List outstanding documents: surety details, proof of address, employment letter, treatment place confirmation.
AI must not
- Must not receive the client's instructions, admissions or account of the offence in any consumer or public AI tool.
- Must not draft or rephrase the accused's affidavit, a surety's statement or a character reference (SC Gen 23 paras 12–13).
- Must not supply authorities; every case relied on comes from the lawyer's own research.
The lawyer checks
- Confirm the version of the Bail Act in force on the hearing date, including whether show cause or a special limitation applies.
- Verify every fact against the instructions, the facts sheet and the record, and every citation against the source (SC Gen 23 para 16), not by AI alone (para 17).
- Confirm s 74 grounds before making a further release application to the same court.
Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
