When to use it

Use for each monitoring period of a facility that may be covered by the Safeguard Mechanism, and update it when the baseline and the reported net emissions are known.

Used for these tasks

Each task page says how far AI may help with the task and what the lawyer must review.

How AI may be used

AI may place reported figures and statutory dates into the calendar. The lawyer decides coverage, the surrender number and which units are surrendered.

AI may

  • Enter the NGER-reported scope 1 figure and the baseline figure from documents the lawyer identifies
  • Insert 31 August and 1 April once the lawyer has named the monitoring period they belong to
  • List ACCUs and SMCs shown on a registry extract without selecting which to surrender

AI must not

  • Must not decide that the facility is covered, or calculate the excess
  • Must not choose between surrender, a flexibility measure and earning SMCs
  • Must not treat a climate-statement scope 1 figure as the safeguard net emissions number

The lawyer checks

  • Coverage is tested against the Regulator's threshold and against the exceptions for covered emissions, using the Safeguard Mechanism Rule and the Measurement Determination
  • The baseline is the baseline the Regulator has set for this facility and this period, not a figure carried forward
  • Any excess is managed before the 1 April deadline the Regulator states, by a choice the lawyer makes
  • NGER registration by 31 August is diarised only where the Regulator's page says a new responsible emitter must register

Method: how the Green, Yellow and Red levels are decided. This is guidance for planning, not legal advice.
