How AI is used
From the will file, list the revoked will or part, and any later re-execution or later will that refers to it. Leave blank whether it is revived, and which part. The tool does not construe the later will.
What the lawyer must review
Section 15 of the Succession Act 2006 (NSW) says a will or part of a will that has been revoked is revived by re-execution or by execution of a will showing an intention to revive the will or part. Revival of a will that was partly revoked and later revoked as to the balance revives only the part most recently revoked, unless a contrary intention appears in the reviving will. A will that has been revoked and is later wholly or partly revived is taken to have been executed on the day it is revived. This is not the check of whether a later document revoked the will.

Checklist

  1. Revival requires re-execution or a later will that shows an intention to revive. A mention of the old will is for the lawyer to read.
  2. If revocation happened in stages, only the most recently revoked part revives, unless the later will shows otherwise.
  3. Date the revived will on the day of revival, not the original execution day.
  4. Do not use this note to decide whether the later document revoked the earlier one. That is a separate check.
