How AI is used
The rule is state law, and the lawyer must confirm which state's law governs. For example, Florida Statutes s 732.505 and s 732.506 state revocation by a later writing and by a physical act. From the file, list a later will or codicil, a later writing, or a described physical act, with its date. Do not decide that the earlier will is revoked.
What the lawyer must review
The rule is state law, and the lawyer must confirm which state's law governs. For example, Florida Statutes s 732.505 revokes a will or codicil, or part of it, by a subsequent inconsistent will or codicil, but only so far as the inconsistency, or by a subsequent will, codicil, or other writing executed with the formalities required for a will and declaring the revocation. Section 732.506 revokes a will or codicil, other than an electronic will, if the testator, or another person in the testator's presence and at the testator's direction, burns, tears, cancels, defaces, obliterates, or destroys it with the intent and for the purpose of revocation. An electronic will or codicil is revoked by deleting, canceling, rendering unreadable, or obliterating it, with that intent, proved by clear and convincing evidence. The tool lists the document or act the file describes. It does not decide that the will is revoked.
