How AI is used
Index the trust, the consents and the purpose the client wants changed. Write no petition, proposed order or brief.
What the lawyer must review
You write and sign the petition. In a state that has enacted Uniform Trust Code § 411, modification of a noncharitable irrevocable trust by the beneficiaries alone requires the court to conclude that the change is not inconsistent with a material purpose, and termination requires the court to conclude that continuance is not necessary to achieve any material purpose. Consent of the settlor and all beneficiaries is a different path (§ 411(a)). A spendthrift clause is not presumed to be a material purpose (§ 411(c)). Other states use different tests. In federal court, Rule 11 is your certification that the legal contentions are warranted after a reasonable inquiry. Model Rule 3.3 forbids a false statement of law to the tribunal. Opinion 512: do not file generated analysis or citations you have not opened.
