List the asset transfers and notices after a change of trustee
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each asset, how title is held, and the office or counterparty named in the file. Do not prepare a deed or a transfer-tax return.
- What the lawyer must review
- After a change of trustee, read the deed's own succession clause first. Uniform Trust Code § 704, if the state has enacted it and the deed is silent, sets the order for filling a vacancy: the person designated in the terms, then unanimous agreement of the qualified beneficiaries for a noncharitable trust, then the court. Section 801's duty to administer arises on acceptance, not before. There is no federal stamp duty to put in this list. Any transfer tax, recording fee or deed form is state law and was not opened. You complete the instruments. Opinion 512: the list must be checked against the asset schedule.
