From the product description the lawyer supplies, list whether the papers call the client a common carrier and whether the product places calls or messages. Quote the words the papers use. Do not conclude that a duty applies.
What the lawyer must review
47 U.S.C. § 201: every common carrier engaged in interstate or foreign communication by wire or radio has a duty to furnish that communication service upon reasonable request, in accordance with the orders of the Commission in the cases the section states, and all charges, practices, classifications, and regulations for that service shall be just and reasonable. A charge, practice, classification, or regulation that is unjust or unreasonable is unlawful. 47 U.S.C. § 227(b)(1)(A) makes it unlawful, with the exceptions the paragraph states, to make a call using an automatic telephone dialing system or an artificial or prerecorded voice to an emergency line, to a guest room or patient room of the kind the clause names, or to a telephone number assigned to a paging service, cellular telephone service, specialized mobile radio service, or other radio common carrier service, or any service for which the called party is charged for the call. Section 227(b)(1)(B) restricts an artificial or prerecorded voice message to a residential telephone line, again with the exceptions the paragraph states, including prior express consent, emergency purposes, and a call made solely to collect a debt owed to or guaranteed by the United States where the text so provides. The lawyer decides whether the client is a common carrier and whether § 227 applies. No Commission rule number was opened.
