Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Set the supplier’s mark-up beside FAR 52.212-4 and list each paragraph the supplier has changed, quoting both texts. Do not accept or reject the mark-up.
- What the lawyer must review
- FAR 52.212-4 is the clause for commercial products and commercial services. Paragraph (c) states that changes in the terms and conditions of that contract may be made only by written agreement of the parties. Paragraph (d) subjects the contract to 41 U.S.C. chapter 71, Contract Disputes, and incorporates FAR 52.233-1 by reference. Paragraph (a) covers inspection and acceptance of supplies or services tendered under that clause. This is not a construction changes clause. Formal Opinion 512: the lawyer checks the comparison before it goes to the contracting officer or the client.
