- For a California resident, list the categories of personal information in the notice, the purposes stated for each category, whether a Do Not Sell or Share link is present if the business sells or shares, and whether the notice is given at or before collection.
- What the lawyer must review
- The California Attorney General's CCPA page says a notice at collection must list the categories of personal information the business collects and the purposes for which it uses those categories, must include a Do Not Sell or Share link if the business sells personal information, and must link to the privacy policy. The notice must be provided at or before the point of collection. The California Privacy Protection Agency's FAQ says the CCPA requires businesses to inform consumers about how they collect, use, and retain personal information, and that a covered business must limit collection, use, and retention to purposes a consumer would reasonably expect, purposes compatible with those expectations and disclosed to the consumer, or purposes the consumer agreed to. The same FAQ gives the for-profit thresholds, including gross annual revenue of $26.625 million or more for the preceding calendar year, effective January 1, 2025.
