List whether the draft prohibits a rental of 30 days or less, and whether it would keep rentals below 25 percent of the separate interests. Do not rewrite the rule.
What the lawyer must review
You decide whether the provision can be adopted or enforced. Civil Code § 4741(a) says an owner of a separate interest shall not be subject to a provision in a governing document, or an amendment, that prohibits, has the effect of prohibiting, or unreasonably restricts the rental or leasing of any of the separate interests, accessory dwelling units, or junior accessory dwelling units in that development. Section 4741(b) says the development shall not adopt or enforce a provision that restricts the rental or lease of separate interests to less than 25 percent of the separate interests. Nothing in that subdivision prohibits a provision authorizing a higher percentage. Section 4741(c) says the section does not prohibit a provision that prohibits transient or short-term rental of a separate property interest for a period of 30 days or less. A separate interest is not counted as renter-occupied if the owner occupies the separate interest or its accessory dwelling unit or junior accessory dwelling unit. Section 4741(g) says a development that willfully violates the section is liable for actual damages and a civil penalty not to exceed one thousand dollars. Section 4350 still requires an operating rule to be in writing, within the board's authority, not in conflict with governing law or the declaration, articles, or bylaws, adopted in good faith and in substantial compliance with the article, and reasonable. The tool does not decide that a restriction is reasonable.
