Draft the written decision from the reasons the board gives. If the board disapproves the change, leave blanks for the explanation and for the reconsideration procedure until the lawyer supplies them.
What the lawyer must review
California Civil Code § 4765 applies if the governing documents require association approval before a member makes a physical change to the member's separate interest or to the common area. The association shall provide a fair, reasonable and expeditious procedure, included in the governing documents, with prompt deadlines and a stated maximum time for response to an application or a request for reconsideration. A decision shall be made in good faith and may not be unreasonable, arbitrary or capricious. It may not violate any governing provision of law, including the Fair Employment and Housing Act, or a building code or other law governing land use or public safety. A decision shall be in writing. If the change is disapproved, the writing shall explain why and describe the procedure for reconsideration by the board, and the applicant is entitled to reconsideration by the board at an open meeting of the board. You take the maximum time from the governing documents. Do not insert a number the statute does not state. You check every sentence. This is California.
