List whether the athlete is a student athlete, whether an agency contract is proposed, and whether the file contains the disclosure document. Do not say a federal license exists.
What the lawyer must review
15 USC 7801: an athlete agent is an individual who enters into an agency contract with a student athlete, or who directly or indirectly recruits or solicits a student athlete to enter into one. The term does not include a spouse, parent, sibling, grandparent, or guardian of the student athlete, legal counsel for purposes other than representative agency, or an individual acting solely on behalf of a professional sports team or professional sports organization. An agency contract is an oral or written agreement in which a student athlete authorizes a person to negotiate or solicit a professional sports contract or an endorsement contract. A student athlete is an individual who engages in, is eligible to engage in, or may be eligible in the future to engage in, any intercollegiate sport. An individual who is permanently ineligible to participate in a particular intercollegiate sport is not a student athlete for purposes of that sport. 15 USC 7802(a) makes it unlawful for an athlete agent to recruit or solicit a student athlete to enter an agency contract by giving any false or misleading information or making a false promise or representation, or by providing anything of value to the student athlete or anyone associated with the student athlete before the agency contract, including a loan or acting as a guarantor or co-guarantor; to enter an agency contract without providing the disclosure document in subsection (b); or to predate or postdate an agency contract. Subsection (b) requires the disclosure in conjunction with entering the contract, to the student athlete, or, if the student athlete is under 18, to the parent or legal guardian. The disclosure is separate from and in addition to any disclosure state law may require. It must be signed by the student athlete, or by the parent or guardian if the athlete is under 18, before the contract. In close proximity to that signature it must contain a conspicuous notice in boldface type stating the warning printed in subsection (b)(3): agreeing orally or in writing to be represented by an agent now or in the future may lose eligibility to compete as a student athlete, and within 72 hours after entering the contract or before the next athletic event in which the athlete is eligible to participate, whichever occurs first, both the athlete and the agent must notify the athletic director, or the individual responsible for athletic programs, that an agency contract has been entered. State athlete-agent registration statutes were not opened. This statute does not regulate an agent for a player who is not a student athlete. It is not a federal license.
