Assess first home buyer transfer-duty concession eligibility
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the contract and the buyer's instructions, record the contract date, the price or value, whether the property is a home or vacant land, who the buyers are, any prior residential ownership or earlier grant or concession, citizenship or residence status, and the residence the buyers propose. Do not say the concession is available.
- What the lawyer must review
- The lawyer decides which threshold table the contract date attracts, whether each buyer is eligible, and whether the residence condition can be met. The lawyer does not treat eligibility as an answer to foreign surcharge duty.

Checklist
- Use the contract date to pick the band. Do not apply the post-1 July 2023 New South Wales home band to an earlier contract.
- Ask about the spouse or partner's earlier ownership, not only the buyer named on the contract.
- Do not treat the concession as an exemption from surcharge purchaser duty or foreign purchaser additional duty.
- Do not state the New Zealand citizen rule for a Victorian transaction before 26 November 2025, or the family-violence test. Those pages were not opened.
