Log the request: date received, channel, whether the message the client describes is an advertisement, and whether the person asked to stop email or to opt out of sale or sharing. Draft no reply.
What the lawyer must review
The FTC's CAN-SPAM guide covers commercial email, defined as email whose primary purpose is the commercial advertisement or promotion of a commercial product or service, including business-to-business email. The message needs accurate headers, a subject line that reflects the content, a clear statement that it is an advertisement, a valid physical postal address, and a working opt-out. An opt-out must be honoured within 10 business days. The mechanism must work for at least 30 days after the message is sent. A fee, or a demand for more than an email address, is not allowed. A CCPA opt-out of sale or sharing, which the Attorney General describes, is a different request and is answered by the business, not by treating it as an email unsubscribe.
