How AI is used
Record whether the call is a covered telemarketing call, whether the number is on the National Do Not Call Registry, whether the consumer previously asked that seller to stop, and whether the Registry download is more than 31 days old.
What the lawyer must review
Under the Telemarketing Sales Rule it is a violation to call a number on the National Do Not Call Registry, and a separate violation to call a consumer who has asked not to receive calls from or on behalf of a particular seller. Sellers and telemarketers must use a Registry version no more than 31 days old. The FTC guide states that only phone numbers are on the Registry, so household members who share a number stop receiving most telemarketing calls once it is registered, and that both landline and wireless numbers may be registered. The FCC guide adds that robocall and robotext consent rules apply even when the number is not on the Registry, and that a person may opt out of any robocall or robotext at any time in any reasonable manner.
